ประกาศว่าด้วยการคุ้มครองข้อมูลส่วนบุคคล

สำหรับสมาชิก ผู้สมัครสมาชิก  ผู้ใช้บริการ และบุคคลทั่วไป

              ราชพฤกษ์คลับ ภายใต้บริษัท นอร์ธ ปาร์ค เรียลเอสเตท จำกัด และบริษัท นอร์ธปาร์ค กอล์ฟแอนด์สปอร์ตคลับ จำกัด (“ราชพฤกษ์คลับ”) ในฐานะเป็นผู้ควบคุมข้อมูลส่วนบุคคล เคารพในสิทธิความเป็นส่วนตัวของท่าน และตระหนักถึงความสำคัญในการเก็บรักษาข้อมูลส่วนบุคคลของท่าน (“ข้อมูลส่วนบุคคล”)“ราชพฤกษ์คลับ” จึงได้จัดทำประกาศว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลสำหรับสมาชิก ผู้ใช้บริการ และบุคคลทั่วไป (“ประกาศฯ”) ฉบับนี้ขึ้น เพื่อการคุ้มครองข้อมูลส่วนบุคคลของท่านตามกฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคล ดังนี้

1. วัตถุประสงค์ในการเก็บ รวบรวม ใช้ ประมวลผล เปิดเผยข้อมูลส่วนบุคคล

“ราชพฤกษ์คลับ” มีวัตถุประสงค์ในการเก็บรวบรวม ใช้ ประมวลผล หรือเปิดเผย “ข้อมูลส่วนบุคคล” ของท่าน (“วัตถุประสงค์”) ดังต่อไปนี้ 

• เพื่อตรวจสอบคุณสมบัติของท่าน การสัมภาษณ์ พิจารณาอนุมัติการสมัคร ใช้สิทธิ หรือคำร้องใด ๆ ที่เกี่ยวข้องกับสัญญาสมาชิก หรือขอรับบริการภายใน “ราชพฤกษ์คลับ” จัดทำข้อตกลง สัญญา และเอกสารที่เกี่ยวข้อง ยืนยันหรือระบุตัวตนของท่านในการเข้าใช้บริการ และร่วมกิจกรรมต่าง ๆ ของ “ราชพฤกษ์คลับ” ตามข้อกำหนดของสัญญาสมาชิกประเภทต่าง ๆ หรือข้อกำหนดที่เกี่ยวข้องกับการให้บริการที่ “ราชพฤกษ์คลับ” มีต่อท่าน
• เพื่อตรวจสอบและดำเนินการเกี่ยวกับการรับ-ชำระเงิน ได้แก่ ค่าสมัคร ค่าบำรุง เงินฝากประกันความเสียหาย ค่าสินค้าและบริการ หรือค่าใช้จ่ายอื่น ระหว่าง “ราชพฤกษ์คลับ” กับท่าน ต่อสถาบันการเงิน สถาบันผู้ออกบัตรเครดิต หรือบัตรเดบิต  รวมถึงการสมัครขอใช้บริการชำระผ่านบัญชีบัตรเครดิต บัญชีบัตรเดบิต หรือหักจากบัญชีธนาคารที่ท่านแจ้งความประสงค์ไว้ด้วย
• เพื่อสื่อสาร แจ้งข้อมูลข่าวสาร สำรวจความคิดเห็น และจัดทำสื่อประชาสัมพันธ์ของ “ราชพฤกษ์คลับ” ที่เผยแพร่ผ่านช่องทางการสื่อสารต่างๆ
• เพื่อจัดทำกิจกรรมส่งเสริมการขายและการตลาดเกี่ยวกับสินค้าและการให้บริการต่าง ๆ ของ “ราชพฤกษ์คลับ” รวมทั้งการโฆษณาประชาสัมพันธ์กิจกรรม โปรโมชั่น สินค้า และบริการ ตลอดจนให้คำแนะนำที่เหมาะสมเพื่อประโยชน์สูงสุดและตอบสนองความต้องการของท่าน
• เพื่อศึกษา วิจัย จัดทำสถิติ บริหารจัดการ พัฒนาและปรับปรุง สินค้าและการให้บริการของ “ราชพฤกษ์คลับ” เพื่อประโยชน์สูงสุดของท่าน
• เพื่อรักษาความปลอดภัย ป้องกันการกระทำความผิดตามกฎหมาย หรือระเบียบข้อบังคับของ “ราชพฤกษ์คลับ” และปฎิบัติหน้าที่ตามกฎหมาย กฎเกณฑ์ที่เกี่ยวข้องที่ใช้บังคับกับ “ราชพฤกษ์คลับ”
• เพื่อวัตถุประสงค์อื่นที่เกี่ยวข้องกับวัตถุประสงค์ที่ระบุไว้ข้างต้น

2. การเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคล

การเก็บรวบรวม ใช้ และเปิดเผย “ข้อมูลส่วนบุคคล” ของท่าน จะต้องได้รับความยินยอมจากท่าน(ยกเว้นกรณีจำเป็นเพื่อดำเนินการตามสัญญา ซึ่ง “ราชพฤกษ์คลับ” ได้รับการรับรองจากผู้ให้ข้อมูลส่วนบุคคลของท่านว่า ท่านยินยอมให้เปิดเผยข้อมูล) และ “ราชพฤกษ์คลับ” จะเก็บรวบรวม ใช้ และเปิดเผย “ข้อมูลส่วนบุคคล” ดังกล่าว เท่าที่จำเป็นภายใต้ขอบเขตของวัตถุประสงค์ที่ท่านได้ให้ความยินยอมไว้แก่ “ราชพฤกษ์คลับ”

ความยินยอมในการเก็บรวบรวม ใช้ และเปิดเผย “ข้อมูลส่วนบุคคล” ของท่าน ไม่ใช่เงื่อนไขการเข้าถึงการบริการหรือช่องทางการสื่อสารของ “ราชพฤกษ์คลับ”  อย่างไรก็ตาม กรณีที่การให้บริการ การดำเนินการหรือการปฏิบัติตามสัญญาของ “ราชพฤกษ์คลับ” บางประการจำเป็นต้องอาศัย “ข้อมูลส่วนบุคคล” ของท่าน และท่านไม่ให้ความยินยอมหรือเพิกถอนความยินยอมในภายหลังอาจก่อให้เกิดข้อจำกัดในการให้บริการ หรือเข้าถึงช่องทางการสื่อสาร หรือการปฏิบัติตามสัญญาได้อย่างครบถ้วน

3. นโยบายคุกกี้

        “คุกกี้” คือ ข้อมูลที่มีการส่งไปยังระบบของท่านผ่านโปรแกรมการเข้าถึงเว็บไซต์ต่าง ๆ (Web browser) โดยเจ้าของโปรแกรมการเข้าถึงเว็บไซต์นั้น และผ่านเว็บไซต์ www.rajpruek.com หรือแอพพลิเคชั่นของ “ราชพฤกษ์คลับ” (“เว็บไซต์ของราชพฤกษ์คลับ”) และเมื่อมีการติดตั้งข้อมูลดังกล่าวไว้ในระบบของท่านแล้ว การเปิดใช้งานคุกกี้จะทำให้ท่านได้รับความสะดวกสบายในการใช้งาน “เว็บไซต์ของราชพฤกษ์คลับ” มากยิ่งขึ้น เนื่องจากคุกกี้จะทำหน้าที่เก็บรวบรวมข้อมูลการใช้งานและการตั้งค่าของท่านโดยอัตโนมัติ เช่น ข้อมูล การล็อกอิน รวมถึงเว็บไซต์ที่เข้าเยี่ยมชมทั้งก่อนและหลัง “เว็บไซต์ของราชพฤกษ์คลับ” เป็นต้น

        “เว็บไซต์ของราชพฤกษ์คลับ” ใช้คุกกี้ (cookies) หรือไฟล์ข้อมูลขนาดเล็กเพื่อช่วยให้ “ราชพฤกษ์คลับ”สามารถพัฒนา หรือปรับปรุงแก้ไข “เว็บไซต์ของราชพฤกษ์คลับ” ให้ดียิ่งขึ้น เพื่อตอบสนองความต้องการ ในการใช้งานของท่านได้อย่างถูกต้อง แม่นยำ และสะดวกมากยิ่งขึ้น

        เมื่อท่านได้ยอมรับคุกกี้ในการเข้าใช้บริการ “เว็บไซต์ของราชพฤกษ์คลับ” แล้ว การใช้บริการ “เว็บไซต์ของ ราชพฤกษ์คลับ” อย่างต่อเนื่องในครั้งต่อไปโดยไม่เปลี่ยนแปลงการตั้งค่าบนอินเตอร์เน็ตเบราว์เซอร์ อุปกรณ์ของท่านจะยอมรับคุกกี้โดยอัตโนมัติ ซึ่งหากท่านไม่ต้องการให้คุกกี้ทำการรวบรวมข้อมูล ท่านสามารถเลือกเปลี่ยนแปลงการตั้งค่ายอมรับที่ ส่วน “การตั้งค่า” ของแถบเครื่องมือบนอินเตอร์เน็ตเบราว์เซอร์ของท่านได้

4. ระยะเวลาเก็บรวบรวมข้อมูลส่วนบุคคล

         “ราชพฤกษ์คลับ” จะเก็บรวบรวม “ข้อมูลส่วนบุคคล” ตราบเท่าที่จำเป็นต่อการประมวลผล  และข้อผูกพันหรือสิทธิเรียกร้องหรือหน้าที่ทางกฎหมาย

5. การเปิดเผยข้อมูลส่วนบุคคล

         “ราชพฤกษ์คลับ” อาจเปิดเผย “ข้อมูลส่วนบุคคล” ของท่าน ภายใต้วัตถุประสงค์และหลักเกณฑ์ที่กฎหมายกำหนดไว้ ให้แก่บุคคลและหน่วยงานดังต่อไปนี้

(ก)  “ราชพฤกษ์คลับ” หมายถึง บริษัท นอร์ธ ปาร์ค เรียลเอสเตท จำกัด และ/หรือบริษัท นอร์ธปาร์ค                       กอล์ฟแอนด์สปอร์ตคลับ จำกัด ให้หมายความรวมถึงผู้บริหาร กรรมการ พนักงาน ลูกจ้าง และ/หรือพนักงานภายในของ “ราชพฤกษ์คลับ” ดังกล่าวเท่าที่เกี่ยวข้อง และตามความจำเป็นเพื่อการประมวลผล “ข้อมูลส่วนบุคคล” ของท่าน

(ข)คู่ค้าทางธุรกิจ ผู้ให้บริการ และผู้ประมวลผล “ข้อมูลส่วนบุคคล” ที่ “ราชพฤกษ์คลับ” มอบหมายหรือว่าจ้างให้ทำหน้าที่บริหารจัดการ/ประมวลผล “ข้อมูลส่วนบุคคล” ให้แก่ “ราชพฤกษ์คลับ” ในการให้บริการต่าง ๆ เช่น การให้บริการด้านการแพทย์ ด้านเทคโนโลยีสารสนเทศ บริการบันทึกข้อมูล บริการชำระเงิน บริการรับส่งไปรษณีย์ บริการรับส่งพัสดุ บริการจัดพิมพ์ บริการประกันภัย บริการการฝึกอบรม บริการวิเคราะห์ข้อมูล บริการทำการวิจัย การทำการตลาด หรือบริการอื่นใดที่อาจเป็นประโยชน์ต่อท่าน หรือเกี่ยวข้องกับการดำเนินธุรกิจของ “ราชพฤกษ์คลับ” เช่น ธนาคารพาณิชย์ โรงพยาบาล ผู้รับประกันภัย

(ค)ที่ปรึกษาของ “ราชพฤกษ์คลับ” เช่น ที่ปรึกษากฎหมาย ทนายความ ผู้ตรวจสอบบัญชี นักคณิตศาสตร์ประกันภัย หรือผู้เชี่ยวชาญอื่นใด ทั้งภายในและภายนอกของ “ราชพฤกษ์คลับ”

(ง)หน่วยงานของรัฐที่มีหน้าที่กำกับดูแลตามกฎหมาย หรือที่ร้องขอให้เปิดเผย “ข้อมูลส่วนบุคคล” โดยอาศัยอำนาจตามกฎหมาย หรือที่เกี่ยวข้องกับกระบวนการทางกฎหมาย หรือที่ได้รับอนุญาตตามกฎหมายที่เกี่ยวข้อง เช่น กรมสรรพากร กรมการปกครอง สำนักงานตำรวจแห่งชาติ ศาล และกรมบังคับคดี เป็นต้น

(จ)บุคคลหรือหน่วยงานอื่นใดที่ท่านให้ความยินยอมให้เปิดเผย “ข้อมูลส่วนบุคคล”ของท่านต่อบุคคลหรือหน่วยงานนั้น ๆ  

6. สิทธิตามกฎหมายของเจ้าของข้อมูลส่วนบุคคล

• สิทธิในการเพิกถอนความยินยอมในการเก็บรวบรวม ใช้ และเปิดเผย “ข้อมูลส่วนบุคคล”
• สิทธิในการขอเข้าถึงหรือขอรับสำเนา “ข้อมูลส่วนบุคคล” ของท่าน หรือขอให้ “ราชพฤกษ์คลับ” เปิดเผยถึงการได้มาซึ่งข้อมูลที่ท่านไม่ได้ให้ความยินยอมไว้
• สิทธิในการขอรับ ส่ง หรือโอนย้าย “ข้อมูลส่วนบุคคล” ของท่านที่ได้ให้ไว้กับ “ราชพฤกษ์คลับ” ไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่น
• สิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผย “ข้อมูลส่วนบุคคล”
• สิทธิในการขอลบ หรือทำลาย หรือทำให้ “ข้อมูลส่วนบุคคล” อยู่ในรูปแบบข้อมูลที่ไม่สามารถระบุตัวตนบุคคลที่เป็นเจ้าของข้อมูลได้
• สิทธิในการขอให้ระงับการใช้ “ข้อมูลส่วนบุคคล”
• สิทธิในการขอให้ดำเนินการให้ “ข้อมูลส่วนบุคคล” นั้นถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด
• สิทธิในการร้องเรียนในกรณีที่มีการฝ่าฝืนกฎหมายคุ้มครองข้อมูลส่วนบุคคล

ทั้งนี้ ภายใต้หลักเกณฑ์ที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลกำหนดไว้

ในกรณีที่ท่านประสงค์จะใช้สิทธิดังกล่าวข้างต้น โปรดติดต่อไปยังบุคคลที่ระบุในข้อ 11. 

7. มาตรการรักษาความปลอดภัย

         “ราชพฤกษ์คลับ” ได้จัดให้มีระบบการปกป้อง “ข้อมูลส่วนบุคคล” จากการเข้าถึง การเปลี่ยนแปลง และการทำลาย โดยไม่ได้รับอนุญาต โดย “ราชพฤกษ์คลับ” ตกลงใช้ระบบรักษาความปลอดภัยที่เหมาะสม เพื่อคุ้มครอง “ข้อมูลส่วนบุคคล” และในการรวบรวม ใช้ และ/หรือเปิดเผย “ข้อมูลส่วนบุคคล” ไม่ว่าทั้งหมดหรือบางส่วน  “ราชพฤกษ์คลับ” ตกลงดำเนินการตามสิทธิและหน้าที่ที่พึงมีหรือพึงปฏิบัติตามกฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคล

8. บุคคลที่ได้รับอนุญาตให้เข้าถึงข้อมูลส่วนบุคคล

        เฉพาะเจ้าหน้าที่ของ “ราชพฤกษ์คลับ” หรือบุคคลที่ “ราชพฤกษ์คลับ” มอบหมายให้มีหน้าที่ หรือ ความรับผิดชอบเกี่ยวข้องกับวัตถุประสงค์การใช้ “ข้อมูลส่วนบุคคล” หรือเพื่อปฏิบัติตามกฎหมายเท่านั้นที่มีสิทธิเข้าถึง “ข้อมูลส่วนบุคคล” ของท่านได้ โดย “ราชพฤกษ์คลับ” จะควบคุมให้เฉพาะเจ้าหน้าที่ของ “ราชพฤกษ์คลับ” หรือบุคคลที่ “ราชพฤกษ์คลับ” มอบหมายดังกล่าวสามารถเข้าถึง “ข้อมูลส่วนบุคคล” ของท่านได้

9. การแก้ไขเปลี่ยนแปลงประกาศฉบับนี้

        “ราชพฤกษ์คลับ” อาจพิจารณาทบทวน “ประกาศฯ” ฉบับนี้เพื่อให้สอดคล้องกับแนวปฏิบัติและกฎหมาย หรือข้อบังคับที่เกี่ยวข้อง ทั้งนี้ หากมีการเปลี่ยนแปลงประกาศฉบับนี้  “ราชพฤกษ์คลับ” จะประกาศผ่าน “เว็บไซต์ของราชพฤกษ์คลับ”  หรือช่องทางการสื่อสารอื่นของ “ราชพฤกษ์คลับ”  

10. กฎหมายที่ใช้บังคับ

        ประกาศฉบับนี้อยู่ภายใต้บังคับของกฎหมายไทย และศาลไทยมีเขตอำนาจในการพิจารณาข้อพิพาทที่เกิดขึ้น

11. ติดต่อราชพฤกษ์คลับ

        หากท่านมีข้อสอบถามเกี่ยวกับ “ประกาศฯ” ฉบับนี้ หรือประสงค์ที่จะใช้สิทธิของเจ้าของข้อมูลส่วนบุคคลในข้อ 6 ท่านสามารถติดต่อฝ่ายคุ้มครองข้อมูลส่วนบุคคลของ “ราชพฤกษ์คลับ” ผ่านช่องทางดังต่อไปนี้

            Rajpruek Club by North Park Real Estate Co., Ltd. and North Park Golf & Sport Club Co., Ltd. (“Rajpruek Club”), as the data controller, respects your right to privacy and is aware of the importance of the collection of your personal data (“Personal Data”), hence, Rajpruek Clubhas published this Personal Data Protection Notice for Members, Membership Applicants, Service Receivers and Guests (“Notice”) in order to protect your Personal data in accordance with the Personal Data Protection Laws as follows:

1. Purposes of storing, collecting, using, processing and disclosing the Personal Data 

Rajpruek Club’s purposes of storing, collecting, using, processing and disclosing your Personal Data are as follows: (“Purposes”):

For verifying your qualification, interviewing, considering your application, exercising of rights or any requisition related to a membership agreement or a request to receive services within  Rajpruek Club, entering into an agreement, contract and related documents, confirming or identifying your identity in order to receive a service and participate in any event of Rajpruek Club according to the terms and conditions under various type of membership agreement or terms and conditions related to a service provided to you by Rajpruek Club.
2. For verifying and proceeding with financial institutions, credit or debit card issuers regarding the collection or payment of application fee, maintenance fee, security deposit for damages, goods and services fee or other expenses between you and Rajpruek Club, including application for payments to be made via credit card, debit card or bank account as requested by you.
3. For communicating, distributing information, surveying opinions and making advertising media of Rajpruek Club to be publicized through various communication channel.
4. For making promotional and marketing activities related to goods and services of Rajpruek Club including publicizing activities, promotions, goods and services as well as providing appropriate recommendations in response to your needs and for your utmost benefits.
5. For studying, researching,collecting statistical data of, managing, developing and improving goods and services of Rajpruek Club for your utmost benefits.
6. For maintaining security, preventing any activity in violation of the laws or regulations of Rajpruek Club and performing obligations in accordance with applicable laws and rules.
7. For other purposes in connection with the aforementioned purposes.
8. Collection, use and disclosure of Personal Data

The collection, use and disclosure of your Personal Data must be performed with your consent (except in case of necessity in order to perform a contractual obligation which your consent for disclosure of such information is certified by a person providing your Personal Data to Rajpruek Club) and Rajpruek Club will collect, use and disclose such Personal Data to the extent necessary and within the purposes you have given consent to Rajpruek Club.

Your consent for the collection, use and disclosure of your Personal Data is not a condition for accessing Rajpruek Club’s services or communication channels, however, in case of some services, operations, or contractual obligations of Rajpruek Club require your Personal Data and you decide not to give or thereafter withdraw your consent, such decision may lead to a restriction in completely providing the services, granting access to communication channels or performing contractual obligations.

“Cookies” is information which will be sent to your system through web browser by the owner of such web browser and through website www.rajpruek.comor application of Rajpruek Club (collectively “Rajpruek Club’s Website”). Once the cookies is installed in your system, the activation of cookies will bring more convenience to your use of Rajpruek Club’s Website because cookies will automatically collect your usage and settings information, such as login information and information of the websites you access, whether before or after accessing Rajpruek Club’s Website, etc.

Rajpruek Club’s Website uses cookies or small information file to help Rajpruek Club be able to develop or improve Rajpruek Club’s Website so as to allow Rajpruek Club to be more correctly, accurately and conveniently in response to your needs.

1. Rajpruek Club means North Park Real Estate Co., Ltd. and/or North Park Golf & Sport Club Co., Ltd. which shall include executives, directors, staff, employees and/or internal staff of Rajpruek Club as relevant to and as necessary to the process of your Personal Data.
2. Business partners, service providers and data processors of Personal Data that are (i) assigned or employed by Rajpruek Club to manage or process Personal Data for Rajpruek Club’s services, such as medical services, informational technology services, data saving services, payment services, post services, parcel delivery services, printing services, insurance services, training services, data analytics services, researching services, marketing services or other services which may be beneficial to you; or (ii) related to the business operation of Rajpruek Club, e.g., commercial banks, hospitals or insurers.
3.  Advisors of Rajpruek Club, whether internal or external advisors, such as legal advisors, lawyers, auditors, actuaries or other experts.
4. Government organizations which (i) have regulatory duties according to the laws; (ii) request the disclosure of Personal Data using legal authority; (iii) is related to legal proceedings; or (iv) have permission under applicable laws, such as Revenue Department, Department of Provincial Administration, Royal Thai Police, Court, Legal Execution Department, etc. 
5. Other persons or organizations which your consent have been obtained for your Personal Data to be disclosed to such persons or organizations.

8. Right to request access to or obtain copy of your Personal Data or to request Rajpruek Club to disclose of the acquisition of your Personal Data obtained without your consent.
9. Right to obtain your Personal Data given to Rajpruek Club or request such Personal Data to be sent or transferred to other data controllers.
10. Right to object to a collection, use or disclosure of your Personal Data.
11. Right to request for your Personal Data to be erased, destroyed or made anonymized to become the anonymous data which cannot identify the data subject.
12. Right to request to suspend the use of your Personal Data.
13. Right to request for your Personal Data to be revised or modified to be accurate, up to date, complete and not misleading.
14. Right to complain if there is any violation of the Personal Data Protection Laws.

However, these rights are subject to the guidelines specified in the Personal Data Protection Laws.

Rajpruek Club has set up a system to protect Personal Data from being accessed, revised and destroyed without permission.
